Draft — not yet reviewed by an attorney
This page is a starting-point draft, not final legal advice. Have a licensed attorney review it — particularly around student-data handling (FERPA) and children's privacy (COPPA), which apply to parts of PSG's work with K-12 districts — before relying on it as your published policy.
Terms of Service
Effective date: August 12, 2026
These Terms of Service (“Terms”) govern your use of the psgintelligence.com website, operated by Performance Standards Group (“PSG,” “we,” “us”). By using this website, you agree to these Terms. This page covers the marketing website only — use of the separate, password-protected PSG Intelligence system by partner districts and schools is governed by that partner's individual engagement agreement with PSG, not by these Terms.
Use of this website
This website is provided to give prospective and current clients information about PSG's consulting services and to allow you to request a consultation. You agree to use it only for lawful purposes and not to attempt to disrupt its operation, probe it for vulnerabilities without authorization, or submit false or malicious information through the consultation form.
Intellectual property
The content on this website — including the PSG name, logo, the PSG Framework, and all written content — is the property of Performance Standards Group or its licensors and is protected by applicable intellectual property laws. You may view and share this content for personal, non-commercial reference, but may not reproduce, republish, or use it commercially without our written permission.
No warranty
This website and its content are provided “as is,” without warranties of any kind, express or implied. We do not guarantee that the website will be uninterrupted, error-free, or secure, and information on this site — including outcome descriptions and case studies — is illustrative and does not guarantee any particular result for your organization.
Limitation of liability
To the fullest extent permitted by law, PSG is not liable for any indirect, incidental, or consequential damages arising from your use of this website. Nothing in these Terms limits liability that cannot be limited under applicable law.
Third-party links and services
This website may link to third-party resources and uses third-party infrastructure (including Netlify for hosting and form processing). We are not responsible for the content or practices of third-party sites or services.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles — confirm this is the correct jurisdiction for PSG's actual business registration with counsel before publishing.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the website after changes take effect constitutes acceptance of the updated Terms.
